The Legal and Regulatory Aspects of Nonconforming Rights

The Old Louisville Neighborhood Council's committee on Zoning and Land Use (ZALU) will host a meeting and Q & A period regarding nonconforming rights. ZALU, along with Center For Neighborhoods, invite all interested neighborhoods and citizens to attend.

The County Attorney's Office and Metro Department of Planning and Zoning have offered to provide a "tutorial" program on the legal and regulatory aspects of nonconforming rights. As many neighborhoods that have experienced nonconforming rights issues know, the cases can become quite contentious and difficult to deal with due to the particulars of each property, verifying building uses in the past and conflicting accounts of when and how the building was modified.

This meeting will address the following issues:

• legal and regulatory aspects
• how the rights are acquired
• how the rights are maintained
• evidence to prove or disprove the existence of nonconforming rights
• events that contribute to loss of such rights
